TUPE stands for The Transfer of Undertakings (Protection of Employment) Regulations 2006. They protect employees when their employer changes. The employer can change in a number of ways, including when two businesses merge, or when work is outsourced. If TUPE applies then an employee’s length of service is protected as well as the terms of the contract of employment. If an employee is dismissed because of a transfer, then this can lead to a claim for unfair dismissal.
