Managing sickness absence

Employers and managers need to know how to deal with cases of sickness absence which can take different forms:

  • Recurrent short-term absences.
  • Long-term absence.
  • Disability-related absence.
  • Maternity-related sickness absence.
  • Absence alleged to have been caused by the employer's conduct or that of colleagues (for example, the result of overwork, bullying or harassment).

In some cases an employer may dispute that an employee is genuinely unwell. In any case of sickness absence an employer will need to consider the effect of an employee's absence on colleagues and the employer's business. If an employee returns to work after long-term absence employers will need to consider the means by which they wish to reintroduce them to the workplace, a phased return to work may be recommended. Return to work interviews are also a useful means of reassuring returning employees, checking that any anticipated adjustments to their job have been implemented and whether they have any remaining concerns that the employer should address.

If an employer terminates an employee's employment, they will want to ensure that they are protected from any claims the employee might bring, particularly for unfair dismissal and disability discrimination.
