These are subject to contract law and require consideration of the terms of the bonus scheme. If your bonus is guaranteed, a claim can sometimes succeed through a simple debt action. However, such a claim can become complicated if your employment has been terminated as it is often dependent on the drafting of your contract and the reason for termination. Claims involving discretionary bonuses, where the employer determines if and how much is payable, can also be complicated and be hard to prove. It is highly recommended that you seek legal advice before pursuing a claim regarding a discretionary bonus.
